Allowances API provides a REST API that aggregates and normalizes per diem and allowance data from the General Services Administration (GSA), Department of Defense (DTMO), and Department of State (DSSR).

2. License Grant

Subject to these Terms and the payment of applicable fees, Allowances API grants you a non-exclusive, non-transferable, non-sublicensable, revocable license to:/p>

  • Integrate the API into your internal systems or commercial software applications.
  • Use the data retrieved from the API to calculate travel expenses and compliance rates for your end-users.

3. Usage Restrictions (Anti-Scraping & Competitive Clause)

This Service is intended for integration, not data harvesting. You specifically agree NOT to:

  • Bulk Scraping: Use the Service to systematically crawl, "scrape," or download the entire database for the purpose of creating a derivative database.
  • Resale of Raw Data: Sell, rent, or lease the raw data retrieved from the API as a standalone data product.
  • Competitive Use: Use the Service to build a product that directly competes with Allowances API’s subscription service.
  • API Key Sharing: Share your API key with third parties or allow unauthorized access to the Service.
  • Circumvention: Attempt to bypass rate limits or access undocumented endpoints.

4. Fees and Payment

  • Subscriptions: Fees are billed in advance on a [Monthly/Annual] basis.
  • Usage Limits: Your plan includes a specific number of requests. Overages may result in service throttling or additional charges as defined in your plan.
  • Refunds: Payments are non-refundable except as required by law.

5. Data Accuracy and Disclaimers

  • Sourced Data: You acknowledge that the data is sourced from US Government agencies. While [Your Company Name] uses commercially reasonable efforts to sanitize and correct known errors (such as ZIP code boundary overlaps), we do not guarantee the 100% accuracy of government-published rates.
  • "As-Is" Basis: The Service is provided "AS IS." [Your Company Name] disclaims all warranties, including the implied warranties of merchantability and fitness for a particular purpose.
  • Audit Responsibility: The Customer is ultimately responsible for verifying rates used in government contract billing. [Your Company Name] is not liable for any audit failures, DCAA penalties, or disallowed costs incurred by the Customer.

6. Intellectual Property

The API structure, documentation, code samples, and "sanitization logic" used to clean government data are the exclusive property of [Your Company Name]. The raw government per diem rates themselves are in the public domain.

7. Intellectual Property

To the maximum extent permitted by law, [Your Company Name] shall not be liable for any indirect, incidental, or consequential damages (including loss of profits or data) arising out of the use of the Service. Our total liability for any claim shall not exceed the amount paid by you for the Service in the twelve (12) months preceding the claim.

8. Termination

  • By Customer: You may cancel your subscription at any time via your dashboard.
  • By Allowances API: We reserve the right to suspend or terminate your access immediately if we detect patterns of usage that suggest bulk scraping, data theft, or breach of the Competitive Use clause.

9. Governing Law

These Terms and any dispute or claim arising out of or in connection with them (including non-contractual disputes) shall be governed by and construed in accordance with the laws of Spain.

Both parties irrevocably agree that the courts of Alicante, Spaisn, shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms.

The United Nations Convention on Contracts for the International Sale of Goods is specifically excluded from application to these Terms.

These Terms are drafted in the English language. If this agreement is translated into any other language, the English language text shall prevail.

10. Data Protection

In accordance with the General Data Protection Regulation (GDPR) and the Spanish LOPDGDD, [Your Company Name] processes personal data (such as user emails and billing info) as a Data Controller. Our Privacy Policy, available at [Link], describes how we handle your data. If you use the API to process personal data of your own end-users, a separate Data Processing Agreement (DPA) may be required.
